Exclusive vs Non-Exclusive Pattern / Placement Print Licensing
Exclusive Licensing $360.00 per design
All pattern designs and / or placement print designs that are purchased as an Exclusive pattern or print will be for use exclusively (as per a signed Agreement document) by the client for a period of 3 years from the date of purchase.
Studio Castro will not on-sell / re-use any part of a design that has been purchased as an Exclusive design for the 3 year licensing period. When approaching the end of an exclusive licensing term, Studio Castro will offer the existing client (pattern ‘owner’) a preferential option to re-license and purchase the design/s for another licensing term.
Once a licensing term concludes for a pattern or placement print design the pattern/print design will once again become property of Studio Castro in full. The client with previous ‘ownership’ must not use this design again after a licensing term has passed without obtaining prior written consent from Studio Castro.
Non-Exclusive Licensing $180.00 per design
All pattern designs and / or placement print designs that are purchased as a non-exclusive pattern or print will be for use (as per a signed Agreement document) by the client non-exclusively for a period of 2 years from the date of purchase. Non-exclusive designs may be licensed by Studio Castro to no more than 5 clients at any given time. Studio Castro will ensure that non-exclusive designs are not licensed to brands/clients that have the same product lines. For example, a non-exclusive print would not be licensed out to two different clients who’s product portfolio includes swimwear at the same time. However, a non-exclusive design may be licensed to a swimwear brand, a homewares brand and a baby wear brand at the same time.
Studio Castro reserves the right to decide and sell up to a maximum of 5 non-exclusive licensing agreements per design at any one time.
When approaching an end of a non-exclusive licensing term Studio Castro will offer the existing client (pattern ‘owner’) a preferential option to re-license and purchase the design/s for another licensing term.
